Terms of service
These terms apply to whosup.com.au and the Whosup booking service. Whosup is operated by Dobin Yang (ABN 65 305 057 430), a sole trader based in Brisbane, Queensland. In these terms, "we" and "us" means Dobin Yang as the operator of Whosup, and "you" means the business using Whosup. By signing up or using the service, you agree to these terms.
The service
Whosup gives appointment businesses an online booking page, a calendar, client records, consent forms, booking reminders and optional card holds for no-shows.
Free month and price
- Your first month is free. You do not need a card to start.
- After that, Whosup costs AUD 19.90 a month per shop, including up to 3 active team members. Each extra team member is AUD 10 a month.
- We do not take a commission on your bookings.
- Prices are in Australian dollars and include GST where it applies.
- Founding partners keep the AUD 19.90 monthly price for as long as their subscription continues without a break.
When the free month ends
Add a card in the app before your free month ends to keep your booking page open. If no card has been added, you have 7 more days. After that, your online booking page pauses, and clients see a message to contact you directly. You can still sign in and use the app, and your data is kept. Add a card at any time to reopen your booking page straight away.
Billing and cancelling
- The subscription is billed monthly in advance to the card you add, through Stripe. Billing starts when your free period ends.
- There is no lock-in contract. You can cancel at any time in the app under Settings, Billing, or by emailing hello@whosup.com.au. Your plan continues until the end of the month you have paid for, and we do not refund part months unless the law requires it.
- If a payment fails, the app will tell you and Stripe will try the payment again. If it stays unpaid, your booking page may pause until payment is made.
- We will give you at least 30 days' notice by email before changing your price.
SMS credits
- Text message reminders and confirmations use prepaid SMS credits, at AUD 0.10 per credit.
- One credit covers one text of up to 160 characters. Longer texts, and texts with Korean or other non-English characters, can use more than one credit.
- If a text cannot be sent, its credits are returned automatically.
- Credits do not expire while your account is open. Unused credits are not refundable unless the law requires it.
Card holds and no-show fees
If you turn on card holds, clients save a card when they book, and you can charge a no-show or late cancellation fee. Cards are saved and charged through your own Stripe account, so you are the merchant and Stripe's terms apply to those payments. You set your fee policy, which clients see before they book, and you are responsible for charging fees fairly and in line with that policy. Whosup does not take a cut of these payments.
Inviting other shops
- Share your invite link from Settings. A shop that signs up through it gets its first 2 months free instead of 1.
- When that shop pays for its first month, you get a month free. If you are still in your free period, we add a month to it. If you are already paying, we take one month's fee off your next bill.
- You can earn up to 12 free months this way. We may withhold or remove rewards for invites to your own businesses, fake accounts or other misuse.
Your data
- Your business data and your clients' data belong to you. You can download it at any time from Settings.
- You are responsible for collecting your clients' information lawfully, for the content of your consent forms, and for having your clients' permission to send them booking messages.
- Our privacy policy explains how we handle personal information.
Fair use
Please do not use Whosup for anything unlawful, to send spam or marketing texts, or in a way that interferes with the service or other customers. We may suspend accounts that do.
Availability
We work to keep Whosup available and reliable, but there may be interruptions for maintenance or reasons outside our control. We will tell you about planned maintenance where we can.
Liability
Nothing in these terms excludes rights you have under the Australian Consumer Law. To the extent the law allows, our liability for any claim relating to the service is limited to resupplying the service or refunding the fees you paid for the month in which the claim arose, and we are not liable for indirect loss such as lost profits.
Changes and governing law
We may update these terms and will tell customers about important changes by email. These terms are governed by the laws of Queensland, Australia.
